Our philosophy is, and has always been, that real estate transactions are complex arrangements that demand the skills and expertise of attoryneys at law. When Opinion 26 was decided, we watched as some of our competitors rushed into local realtors' offices as well as lenders' offices in order to initiate relationships to mine this supposed new source of business. We even stood by as some of those same competitors began to create mirror companies that would handle non-attorney closings, so that the original title agency could loudly proclaim that they were not 'doing closings'.

After all of this, we realized and re-confirmed one basic truth - we are business people. In order to serve our customer base, whether attorneys, realtors, lenders, or the public at large, we must first exist as a financially viable and experienced service operation. Turning down legitimate business and watching our competitors actively solicit closing transactions either openly or secretively, was good for our egos, but lousy for our financial health. Therefore, in order to remain viable so that we could service all of our clients, we decided on a conservative, intelligent course of action that consists of these basic principles:

  1. We would not solicit non-attorney closing business, openly or secretively.
  2. We would not however, refuse to participate in such transactions if they were presented to us and when presented with these transactions we would refer them to local attorneys, if possible, or to licensed closing companies that were in no way affiliated with us.
  3. We would issue all appropriate warnings so as to attempt to include attorneys in every closing.
  4. We would not lie, deceive or prevaricate about this position.
